Whatsapp is one of the most unfiltered social media where any information of any sort can be sent to people around the world. If you are a group admin for any of the group you are a part, there is some serious news. We know that the law in India is very vague in regards with the indecent and insensitive messages sent on groups. But recently in Maharashtra when cases were booked with respect to whatsapp’s messages, the group admin was held liable. This lack of clarity has led to a lot of misuse. Why is the group Admin held liable?
It is very difficult to locate people who have sent messages and the admin has all the power to regulate content running on the group. Depending on what is posted the IPC or IT Act may be applicable.
What if the messages from the group has been transmitted to an individual?
There is no offence in receiving messages. But if the receiver send it further without knowing the genuineness of the message he/she may be made an accused party.
If there is a defence of ignorance that the message of harmful. Does that help?
Well there is onus on the admin to take liability for any kind of harm done and there is another rule which explicitly says that Ignorance of Law is no excuse.
What if the group admin is a foreign national?
Well there are provisions to lodge a complaint against a foreign national and necessary actions can be taken up
